These Terms of Service (“Terms”) govern your access to and use of Mikelle Kamm Photography, LLC’s (“MKP”) website, services, and products (“Services”). Please read these Terms carefully before booking Services.
By accessing or using my Services, you agree to be bound by these Terms.
(a) Deposit: A 50% deposit is required at time of booking to reserve your session date and time. Full payment for services is due prior to services rendered unless otherwise agreed upon.
(b) Payment Due Date: Failure to make payment may result in cancellation of services. All sessions must be paid in full 7 days prior to session date unless otherwise agreed upon. MKP reserves the right to cancel any session NOT paid in full within 7 days prior to the session date and time. MKP will make attempts to contact Client with reminders and is responsible of notifying the Client prior to any cancellations.
(a) Rescheduling policy: If any unforeseen circumstances arise and you need to reschedule, Client is to notify MKP as soon as possible. Client will be offered the option to reschedule and given alternative dates within a reasonable timeframe relative to the original session date. MKP will go above and beyond to fit Client in as soon as possible. If client chooses to cancel completely, the following cancellation policy will be in effect.
(b) Cancellation Policy: Deposits for sessions that have completed the planning and scheduling phase are non-refundable. Cancellations will receive a refund for all monies paid minus the non-refundable 50% deposit. If Client(s) fails to show up for their session without notifying MKP, no refund will be issued.
Mikelle Kamm Photography is to perform all services promised on and by the dates provided within your package. All photos will be taken by MKP. All post-production and photo editing is done by MKP. Deliverables are never to be issued to Client unless they are deemed of the highest quality provided by MKP.
Client will be provided a link to a private, secure portal where they have the ability to manage their profile information, send messages, view their session and package details, manage payments, view their invoice, and access their final gallery. Online portal is supported by Honeybook.com. If needed, please refer to Honeybook.com’s Privacy Policy for further privacy information.
MKP is available 24/7 via text and email. I will respond immediately or the fastest I can within 24 hours. Phone calls missed with no voice messages will not be returned. Voice messages will be responded to via text unless Client asks me (“MKP”) to call them back.
MKP is to provide an estimated window of delivery to Client. MKP reserves the right to adjust delivery windows at any time and is responsible for notifying Client of these changes.
Turn-around time for final galleries are determined by these factors: the size of the project, level of editing services needed, and current volume of work.
Digital Files: Client can download the quantity of digital files specified in Section 2. Digital file costs are already included in the cost of the session and Client will never be asked to pay more than specified above in Section 3. Client is responsible for the selection and downloading of these images. Additional digitals are available for purchase individually or in packages through the Shop in Client’s online gallery.
Prints: All prints ordered through Client’s PicTime gallery are processed, printed and shipped from a professional 3rd party print lab. Delivery windows for prints are determined by this 3rd party print lab. MKP is not responsible for delays or print issues made by the print lab. However, MKP will provide Client with any necessary contact info and assistance in resolving any print lab issues.
Client is responsible for selecting the images they wish to print and submitting their print order through the Shop in their gallery. Prints included in packages are displayed as a credit in the Client’s online portal and price adjustments are applied at checkout. Any orders accidentally placed without the applied credits will need to be resolved with the print lab. I (“MKP”) will always help you with this!
All photographs and content created by MKP are the intellectual property of Mikelle Kamm Photography, LLC. Clients are granted a non-exclusive, non-transferable license to use the photographs for personal or business use. A Print Release issued by MKP is required to use any outside printing services. Clients may not alter, apply filters, sell, or distribute the photographs from MKP.
Clients are responsible for the actions of any and all booking participants. Client is required to resolve all issues with the appropriate plaintiff on their own.
Mikelle Kamm Photography is not liable for any damages, including but not limited to: lost profits, loss of data, or consequential damages arising from the use of my Services. MKP is not liable for any damages to property, equipment, landscape, wildlife, or items as a result of a member of the Client’s party.
These Terms shall be governed by and construed in accordance with the laws of Idaho, without regard to its conflict of law principles.
MKP reserves the right to modify or update these Terms at any time. Changes will be effective immediately upon posting to my website. Your continued use of my Services after any such changes constitutes your acceptance of the new Terms.
